Netherlands Moves to Criminalize Child Influencer Content for Under-15s

(MENAFN) The Dutch government is drafting landmark legislation that would make it a criminal offense to commercially exploit children under 15 in online video content, targeting the booming — and largely unregulated — world of child influencers and family vlogging, a broadcaster reported Monday.

Minister of Social Affairs and Employment Eddy van Hijum Aartsen notified parliament that the Cabinet intends to bring monetized online content featuring minors under the scope of the Child Labour Act, empowering authorities to levy fines and, in egregious cases, pursue criminal prosecution.

The push is backed by fresh research. Recent studies cited by the minister indicate that children appearing in revenue-generating vlogs face heightened vulnerability to pressure, public exposure, and lasting reputational damage. Aartsen further cautioned that prolonged online visibility risks eroding children's self-image and mental well-being, with potential long-term psychological consequences.

"Given the serious risks, clear rules are necessary," Aartsen said, adding that the government is examining how commercial or business-like content production involving children can be regulated more strictly.

The proposed framework is designed to close glaring enforcement gaps in existing regulations, which officials say make it exceedingly difficult to establish whether parents hold a de facto employment relationship with sponsors or platforms profiting from child-centered content.

Critical definitional questions remain unresolved, including how frequently a child must feature in content and precisely what constitutes "commercial" activity under the new rules.

The government has also signaled it will scrutinize the responsibilities of major digital platforms — including YouTube, Instagram, and TikTok — in protecting minors who appear in monetized material. Parallel talks with advertisers are underway to explore additional safeguards for children featured in commercial campaigns.

The Cabinet is targeting autumn for the finalization of the legislative proposals.
